FLORECER STUDIO TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing and using florecer.com ("Website") and purchasing products from Florecer Studio ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or purchase our products.

2. PRODUCTS AND SERVICES

2.1 Product Description

Florecer Studio specializes in handmade custom jewelry including earrings, necklaces, bracelets, and other accessories. All products are individually crafted and may vary slightly from photographs due to the handmade nature of our work.

2.2 Custom Orders

Custom jewelry consultations are available by appointment. Custom orders require approval of design and payment before production begins. Custom orders are non-refundable once production has started.

2.3 Pricing and Payment

All prices are listed in USD and are subject to change without notice. Payment is required at time of order placement for ready-made items or upon design approval for custom pieces.

3. WARRANTY AND REPAIRS

3.1 One-Year Limited Warranty

Florecer Studio provides a one-year limited warranty from the date of purchase for manufacturing defects and unexpected damage under normal wear conditions.

3.2 Covered Repairs

Within the first year of purchase, we will provide:

  • Minor repairs including hook replacement or minor resin damage restoration

  • Complete replacement of earrings if repair is not feasible

  • Assessment and appropriate remedy for unexpected structural damage

3.3 Warranty Exclusions

This warranty does NOT cover:

  • Water damage or damage from exposure to moisture

  • Damage from extreme weather conditions (excessive heat or cold)

  • Normal wear and tear

  • Damage from misuse, accidents, or improper care

  • Loss or theft of items

  • Damage from chemicals, perfumes, or cleaning products

3.4 Warranty Claims

To initiate a warranty claim, contact us within one year of purchase with proof of purchase and clear photographs of the damage. We reserve the right to request return of the item for assessment before providing repair or replacement.

4. SHIPPING AND DELIVERY

4.1 Processing Time

Ready-made items typically ship within 1-3 business days. Custom orders require 2-4 weeks for completion, depending on complexity.

4.2 Shipping Methods

We ship via USPS and other carriers. Tracking information will be provided once items ship.

4.3 Risk of Loss

Risk of loss and title pass to you upon delivery to the shipping carrier.

5. RETURNS AND EXCHANGES

5.1 Ready-Made Items

Returns accepted within 14 days of delivery for unworn items in original condition. Customer is responsible for return shipping costs.

5.2 Custom Items

Custom and personalized items are final sale and cannot be returned or exchanged unless defective.

5.3 Return Process

Contact us before returning any item. Returns without prior authorization may not be processed.

6. INTELLECTUAL PROPERTY

All designs, photographs, descriptions, and content on our website are protected by copyright and other intellectual property laws. Custom designs created for customers become the exclusive property of the customer upon full payment.

7. USER CONDUCT

You agree not to:

  • Use our website for any unlawful purpose

  • Attempt to gain unauthorized access to our systems

  • Interfere with the proper functioning of our website

  • Submit false or misleading information

  • Violate any applicable laws or regulations

8. WEBSITE AVAILABILITY

We strive to maintain website availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of our website at any time.

9. ACCURACY OF INFORMATION

While we strive for accuracy, we do not warrant that product descriptions, pricing, or other content on our website is accurate, complete, or current. We reserve the right to correct errors and update information.

10. LIMITATION OF LIABILITY

Florecer Studio's liability shall not exceed the purchase price of the item. We are not liable for indirect, special, incidental, or consequential damages including but not limited to loss of profits, business interruption, or loss of data.

11. INDEMNIFICATION

You agree to indemnify and hold harmless Florecer Studio, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our website or violation of these terms.

12. DISPUTE RESOLUTION

These terms are governed by the laws of Florida without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these terms or your use of our website shall be resolved in the courts of Florida.

For disputes under $10,000, you agree to resolve disputes through binding arbitration rather than in court, except where prohibited by law.
